
Casper Police have arrested a man on recommended charges of Aggravated Assault, after police allege that a fight at a local motel escalated to one individual brandishing a gun.
According to an arrest affidavit, Benjamin J Macias Sr. was arrested and booked into jail, just before 9:00 pm on April 14th. He was booked under a single recommended charge of Aggravated Assault.
Police say they had received reports of a fight on the 400 block of East A Street in Casper. The reporting party said that two males were in a parking lot, fighting. One of the males allegedly pulled a gun, but did not point it at anyone.
Officers arrived on the scene, and said they could hear two men arguing. Police made contact with the men, and identified Macias as the individual who was alleged to have a gun.
A .38 Special revolver was taken from Macias’ person. It was noted to be unloaded.
The alleged victim in the case, who was noted to be intoxicated, said that Macias had a previous verbal disagreement with the management of the Royal Inn hotel, a few days previously. The alleged victim claimed to have intervened between the manager and Macias at the time.
On the day of the incident, the alleged victim claims that Macias returned to the property and was yelling at the manager. It was claimed that the alleged victim verbally intervened again. Macias was then claimed to have pulled a gun on the alleged victim and said “I’ll f— you up right now.”
The alleged victim described the gun, however, as a possible 9 mm or .38 automatic pistol.
One witness on scene reported the ha had not seen Macias with the gun, but said that Macias had his hand in his pocket and, reported that there was something obviously in the pocket.
Another witness reported that Macias did pull out a gun and say “I’ll shoot your a–, but I would rather whoop your a– instead,” then put the gun away.
Macias, during an interview, denied pointing the gun at the allege victim. Instead saying that he was at the motel looking for a friend, and that the alleged victim had come outside and threatened Macias, and Macias claimed to threaten him back. Macias also claimed that the alleged victim had thrown a punch at him.
Macias was cuffed, arrested, and transported without further incident.
All of those cited or arrested are presumed innocent until convicted in a court of law. Charges are subject to change following official filings from the Natrona County District Attorney’s Office.
